Introduction

The website www.guestinthecity.com (hereafter referred to as the “Guest in the City website”) is a platform of exchange, whose purpose is to help guests connect with local people in order to meet and get to know each other during their stay in France.

The Guest in the City website is operated by Guest in the City SAS, a French company with a share capital of 10,000 euros, and a registered office located at 5 rue de la Touloubre, 13770 Venelles, listed in the Aix-en-Provence trade register under number 821 073 475 (hereafter referred to as “Guest in the City”, “we” or “us”).

By using the Guest in the City website, you agree to be bound by the present Master agreement, which constitutes a contract between Guest in the City and yourself.

1. Purpose of the Guest in the City website
The purpose of the Guest in the City website is to help people meet and get to know each other in France. The Guest in the City website gives visitors from abroad or from France the opportunity to share a meal in a private local home, to take a tour in a local market or in the city they are staying in, to take cooking classes, to take part in wine tasting events, or to stay in a private local home during their stay in France.
Note: the Guest in the City website is for the use of persons over the age of 18, and who have the legal capacity to accept these terms and conditions.

2. Who is the Host?
The Host is the person who accomodates visitors from abroad or from France for a meal or another activity.
Among other activities, the Host can offer a room to stay in their home, a guided tour, a cooking class, or a wine tasting event. Hosts must respect the Host Charter in addition to the present agreement.

3. Who is the Guest?
The Guest is the person who benefits from the services offered by the Host as described above. Guests must respect the Guest Charter in addition to the present agreement.

4. Use of payment services offered by the « MANGOPAY» Company
Payment services are provided to Guest in the City by MANGOPAY S.A., a “société anonyme” company under Luxemburg law, with a share capital of 2,000,000 Euros, and a registered office located at 59 Boulevard Royal, L-2449 Luxemburg, listed under number B173459 in the Luxembourg trade register (hereafter referred to as “MANGOPAY”).

MANGOPAY provides e-money services such as issuing, use and management of e-money.
Those services are used on the website Guest in the City as payment method for services exchanged between Hosts and Guests.

Prior to signing up as a Host or Guest, please make sure to carefully read the terms of use of MANGOPAY, available here.

By agreeing to become a Host or Guest, you are agreeing to comply with the MANGOPAY terms of use.

Creation of a Host or Guest account automatically generates an “Account” as described in the MangoPay terms of use. Acceptance of a service by a Guest and/or provision of a service by a Host creates a “Transaction” as described in the MangoPay terms of use.

5. Posting on the Guest in the City website
Hosts can post a range of contents on the website Guest in the City, including text and pictures, which allow users to know more about Hosts and the services Hosts offer.
Guests can review and rate each Host’s services.
Hosts and Guests are responsible for their own posts on the Guest in the City website. Guest in the City is not responsible for any legal action that may be undertaken in regards to these posts.
Posts published by Hosts and Guests are hereafter referred to as “the Content”.
Hosts and Guests acknowledge and agree that the Content is made public when posted on the website.
This Content can be moderated, edited, modified, translated and removed at all times by Guest in the City, and can be used, fully or partly, for advertisement or promotion purposes.

Hosts also allow Guest in the City to translate their posts into English, which is one of the main languages for the site.

Hosts and Guests can remove their own Content from the Guest in the City website by deleting their user account, or by sending a request by email to contact@guestinthecity.com.

6. Financial conditions
In return for its connecting services, Guest in the City receives a 10% commission on top of the price of the services performed by the Host. This commission is paid by the Guest in addition to the price of the service paid to the Host.

7. Payment methods and conditions
The contribution asked by the Host plus Guest in the City’s commission are paid when the Guest places their order (i.e., prior to the date when the services offered by the Host has been scheduled), using e-money, through MANGOPAY’s collaborative payment unit called a « MANGOPAY Wallet ».

This payment is a “Payment transaction” as described in MANGOPAY terms of use.

Hosts receive the payment of services on their MANGOPAY Wallet two (2) days at the latest after the date scheduled for these services.
In case the Guest would not be satisfied with the services performed by the Host, or if these services were not performed because of the Host, the Guest can block the payment of the contribution to the Host by sending an email to claim@guestinthecity.com. This email must be received by midnight (Paris time) the day after the date scheduled for the event, and must specify the detailed reasons for the non-payment request. If the services were not performed by the Host, or if they were obviously unsatisfactory, the amount of the contribution due to the Host, as well as Guest in the City’s commission, will be fully refunded to the Guest.

In case of a cancellation because of the Guest, the Guest must send an email to cancel@guestinthecity.com at least 48 hours before the date scheduled for the event. In this case, the contribution requested by the Host will be refunded to the Guest, only the 10% commission will be paid to the Guest in the City website. In case of cancellation without a 48-hour notice, the contribution will be fully paid to the Host, and the commission will also be paid to the Guest in the City website.

8. General terms of use for MANGOPAY’s services when using the website Guest in the City
Guest and Host are bound by MANGOPAY’s general terms of use, available here.
In case of a dispute between MANGOPAY and the Host or Guest, Guest in the City may not be held liable.

Also, when the Guest accepts the Host’s services, Guest and Host are the only parties bound by the terms of the contract, excluding Guest in the City. Therefore, in case of a dispute between Host and Guest, Guest in the City cannot be held liable.

9. Local Regulation
Hosts and Guests commit to comply with the local regulation, in particular in regards to alcohol consumption.
Each party will also comply with the regulation of the apartment building or housing estate where the event is to take place.

10. Modification of the master agreement
Guest in the City reserves the right to make changes to the current master agreement any time and without notice. It is strongly recommended that Hosts and Guests print a copy of the master agreement at the date they accept a transaction.

11. Restriction of Guest in the City’s liability in regards to its connecting services
Guest in the City’s liability is restricted to the amount of its commission as regards to its connecting services.

12. Exclusion of Guest in the City’s liability in regards to services performed
Guest in the City
will not in any way be held liable if services offered by Hosts do not go according to their advertisement. Guest in the City will not be held liable if services should be cancelled by the Host, or if the Guest fails to appear for the service.

13. Exclusion of Guest in the City’s liability in regards to its partner’s payment services
Guest in the City may not be held liable in case the payment system of his partner, the MANGOPAY Company, should fail.

14. Guest in the City’s property right on the contents of the Guest in the City website
All texts and pictures included in the website Guest in the City belong to Guest in the City, are copyrighted and protected by intellectual property law. All rights are reserved and copies are strictly forbidden.

15. Illicit Contents on the Guest in the City website
Illicit content on the Guest in the City website is not acceptable. You can alert us of any such content by sending an email to claim@guestinthecity.com

16. Suppressing access to the Guest in the City website
Guest in the City reserves the right to remove, at any time, a Host or Guest account that contains illicit content or violates third-party rights.

17. Cookies and personal data
You acknowledge and agree that Guest in the City can store personal data and other information about yourself on your computer as “cookies”. The use of cookies is only related to the operation of the Guest in the City website. You acknowledge and agree that refusing or limiting the use of cookies on your computer can have a negative impact on your use of the Guest in the City website.

18. Legal notice
The Guest in the City website director of publication is Véronique Prabel. The Guest in the City website is hosted by Infomaniak, a trade company covered by Swiss law.

20. Applicable law
All terms of the current master agreement, as well as all purchase and sales transactions that are mentioned in the current master agreement, will be governed by French law.

21. Court of competent jurisdiction
Whenever possible, the Guest in the City customer service is available to Hosts and Guests to amicably resolve disputes that may arise. In case of failure of the amicable agreement, the Commercial Court of Aix-en-Provence will resolve conflicts.

22. Language of the Master agreement
In case of a difference between the French and English versions of the current master agreement, the French version will prevail.
